residency<\/h2>\n<\/div><\/div>\n\n\n\n<p>First of all, you need to clarify whether or not you are a tax resident or if you have a \u201cdomicile fiscal\u201d status in France. <\/p>\n\n\n\n<p>According to<strong> Article 4B of the Code G\u00e9n\u00e9ral des Imp\u00f4ts (CGI)<\/strong>, you are classed as a tax resident in France if:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Your <strong>main residence<\/strong> is in France.<\/li>\n\n\n\n<li>You have a <strong>professional activity<\/strong> in France (employed or self-employed).<\/li>\n\n\n\n<li>Your <strong>centre of economic interests<\/strong> is in France (investments, business etc).<\/li>\n<\/ol>\n\n\n\n<p>Another way to determine residency in France is if you spend <strong>more than 183 days (6 months)<\/strong> on French soil throughout the<strong> <a href=\"https:\/\/www.impots.gouv.fr\/particulier\/calendrier-fiscal\" target=\"_blank\" rel=\"noreferrer noopener\">tax year<\/a><\/strong>.<\/p>\n\n\n\n<p>The <strong><a href=\"https:\/\/www.gov.uk\/government\/publications\/rdr3-statutory-residence-test-srt\/guidance-note-for-statutory-residence-test-srt-rdr3\" target=\"_blank\" rel=\"noreferrer noopener\">UK Statutory Residence Test<\/a><\/strong> allows you to work out your residence status for an <strong>individual tax year<\/strong>, taking into account the amount of time you spend in the UK and where you work.<\/p>\n\n\n\n<p>Brits also benefit from the <strong><a href=\"https:\/\/www.gov.uk\/government\/publications\/france-tax-treaties\" target=\"_blank\" rel=\"noreferrer noopener\">France\/UK Double Taxation Treaty<\/a> <\/strong>which significantly <strong>reduces the risk of having to pay tax in both the UK and France simultaneously<\/strong>.<\/p>\n\n\n\n<hr class=\"wp-block-separator id=\"taxe-fonci\u00e8re\">Taxe fonci\u00e8re (property tax)<\/h3>\n<\/div><\/div>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-what-is-taxe-fonciere\">What is taxe fonci\u00e8re?<\/h4>\n\n\n\n<p><strong><a href=\"https:\/\/www.french-property.com\/guides\/france\/finance-taxation\/taxation\/local-property-taxes\/fonciere\/\" target=\"_blank\" rel=\"noreferrer noopener\">Taxe fonci\u00e8re<\/a><\/strong>\u00a0(property tax) is an\u00a0<strong>annual tax payable by all property owners<\/strong>. Along with taxe d\u2019habitation, they are the French equivalent of <strong>council tax<\/strong>. <\/p>\n\n\n\n<p>It is based on the <strong>value of the property<\/strong> and the proceeds are used to finance <strong>local public services<\/strong> (road maintenance, pavements, public lighting and green spaces etc). It is paid directly to the Mairie (town hall) of your commune.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-who-is-liable-for-taxe-fonciere\">Who is liable for taxe fonci\u00e8re?<\/h4>\n\n\n\n<p><strong>Taxe fonci\u00e8re\u00a0<\/strong>is\u00a0<strong>payable by the owners of the property on January 1 every year.<\/strong>\u00a0If you buy your property during the year, you will have to pay a proportion of the property tax for the number of months in that year that you have owned it.<\/p>\n\n\n\n<p>Tenants of a property are not affected by this tax, which is not related to the use of the property but to its nature and value.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-how-is-it-calculated\">How is it calculated?<\/h4>\n\n\n\n<p>This local tax is calculated on the basis of the rental value of the property. This corresponds to the annual income that the property would generate if it were rented out.<\/p>\n\n\n\n<p>A tax percentage, voted for by the local authorities, is then applied to this figure. This figure is different for each municipality, especially in the Alpine region.<\/p>\n\n\n\n<p>As the basis for calculating the property tax is the rental value of the property, there are many factors that can affect it, such as the features of the property, its size and its capacity.<\/p>\n\n\n\n<p>Owners are required to declare any changes to their accommodation, such as extensions or the addition of certain equipment, to the local council so that the tax can be recalculated.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>Example<\/strong><\/h5>\n\n\n\n<p>We\u2019ve taken an example from one of our OVO Network partner properties with the following characteristics:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Location:<\/strong> Manigod, Aravis<\/li>\n\n\n\n<li><strong>Capacity:<\/strong> 8<\/li>\n\n\n\n<li><strong>Bedrooms: <\/strong>5<\/li>\n\n\n\n<li><strong>Bathrooms:<\/strong> 3<\/li>\n\n\n\n<li><strong>Floor area:<\/strong> 180m<sup>2<\/sup><\/li>\n\n\n\n<li><strong>Classification:<\/strong> 4*<\/li>\n<\/ul>\n\n\n\n<p><strong>Average annual taxe fonci\u00e8re <strong>(based on the year 2022)<\/strong>: <\/strong>298,00\u20ac.<\/p>\n\n\n\n<p>Do note, that this number is subjective and can change depending on the points in the following section\u2026<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-which-factors-affect-the-taxe-fonciere-rate\">Which factors affect the taxe fonci\u00e8re rate?<\/h4>\n\n\n\n<p>Here are some examples of the features that can affect the cost of property tax:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The <strong>value<\/strong> of the property.<\/li>\n\n\n\n<li>The <strong>size<\/strong> of the plot of land on which it sits.<\/li>\n\n\n\n<li>The <strong>materials<\/strong> used in its construction.<\/li>\n\n\n\n<li>The <strong>facilities<\/strong> (swimming pool, garage, etc).<\/li>\n\n\n\n<li>Any <strong>renovation<\/strong> work carried out.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-how-can-you-reduce-the-cost-of-taxe-fonciere\">How can you reduce the cost of taxe fonci\u00e8re?<\/h4>\n\n\n\n<p>Some local authorities may decide to grant total or partial exemption from property tax for a period of<strong> three years<\/strong> if you have carried ou<strong><a href=\"https:\/\/www.french-property.com\/news\/tax_france\/energy_conservation_relief_taxe_fonciere\" target=\"_blank\" rel=\"noreferrer noopener\">t energy-saving work on your property<\/a><\/strong>.<\/p>\n\n\n\n<p>However, certain conditions must be met:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Your home must have been built before<strong>\u00a0January 1, 1989<\/strong>.<\/li>\n\n\n\n<li>The amount of your energy renovation expenses must exceed\u00a0<strong>10,000\u20ac<\/strong>\u00a0per dwelling in the year preceding the year in which you apply for the exemption. As we mentioned above, combined with the taxe fonci\u00e8re, it\u2019s the French equivalent of <strong>council tax<\/strong>.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-who-is-affected-by-taxe-d-habitation\">Who is affected by taxe d\u2019habitation?<\/h4>\n\n\n\n<p>Taxe d\u2019habitation is payable by the <strong>person who lives in the property<\/strong> as their principal residence on January 1 of the current year. This means that the tenant or a free occupant of the property may be liable.<\/p>\n\n\n\n<p>In addition, it applies whether you use the property for your <strong>principal residence or your second home<\/strong>. So if you buy a property during the year, you will have to part of the taxe d\u2019habitation in proportion to the number of months you occupy it.<\/p>\n\n\n\n<p><strong><a href=\"https:\/\/www.economie.gouv.fr\/particuliers\/taxe-habitation#definition_taxe_habitation\" target=\"_blank\" rel=\"noreferrer noopener\">The French government\u2019s 2018 reforms<\/a>\u00a0<\/strong>of taxe d\u2019habitation provides for a gradual abolition of the tax for main residences. Thus in 2020, about 80% of households whose taxable income was below a certain threshold were exempt.<\/p>\n\n\n\n<p>For the remaining 20%, there was a 30% reduction in 2021. It was 65% in 2022 and should disappear completely in 2023, when\u00a0<strong>no household should pay taxe d\u2019habitation on their main residence<\/strong>.<\/p>\n\n\n\n<p>Please note, however, that\u00a0<strong>taxe d\u2019habitation will continue to apply to<\/strong>\u00a0<strong>second homes and vacant properties<\/strong>. In some areas including Lyon, Paris, Gu\u00e9rande (Loire-Atlantique), Chessy (Seine-et-Marne), Ferney-Voltaire (Ain), Villefranche-sur-Mer (Alpes-Maritimes), Arles (Bouches-du-Rh\u00f4ne) and Marseille, there is also a surcharge of 60%. <\/p>\n\n\n\n<p>If you rent out your second home or chalet, holiday tenants are not liable for taxe d\u2019habitation, but they must pay\u00a0<strong>taxe de s\u00e9jour<\/strong>, or tourist tax. We\u2019ll come onto that later in this article.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-how-is-taxe-d-habitation-calculated\">How is taxe d\u2019habitation calculated?<\/h4>\n\n\n\n<p>Taxe d\u2019habitation is levied for the <strong>benefit of local authorities<\/strong>, which vote on the tax level.<\/p>\n\n\n\n<p>It is calculated according to the value of the property, which is determined by the tax authorities. For UK residents, the tax is payable if you own French property in excess of the same value.<\/p>\n\n\n\n<p>Wealth tax is calculated on <strong>combined household assets<\/strong> (spouses, partners s\u00e9jour?<\/h4>\n\n\n\n<p>Most communes ask holiday guests staying in the mountains for a financial contribution in the form of<strong><a href=\"https:\/\/www.frenchentree.com\/living-in-france\/travel\/what-is-frances-tourist-tax-taxe-de-sejour-and-who-pays-it\/\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a0taxe de s\u00e9jour,<\/a><\/strong>\u00a0or holiday tax. <\/p>\n\n\n\n<p>This is generally used to finance the <strong>development of local tourism<\/strong>, events or the maintenance of green spaces.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-who-has-to-pay-taxe-de-sejour\">Who has to pay taxe de s\u00e9jour?<\/h4>\n\n\n\n<p><strong>Guests<\/strong> staying in a tourist residence, a furnished holiday home or a holiday rental are required to pay a tourist tax at the end of their booking. <\/p>\n\n\n\n<p>This means that the guests who stay in your property will have to pay you a tourist tax, calculated in advance, according to the number of guests, the length of stay and the quality of your property. <\/p>\n\n\n\n<p>The taxe de s\u00e9jour is payable to the owner of the accommodation or to the booking service acting on behalf of them. However, the payment of this tax is often <strong>included in the price of the holiday rental<\/strong>. <\/p>\n\n\n\n<h4 class=\"wp-block-heading\">How is the taxe de s\u00e9jour calculated?<\/h4>\n\n\n\n<p>The amount of taxe de s\u00e9jour must be displayed at the property and on the bill provided to guests. It must also be available for consultation at the Mairie or the local tourist office. <\/p>\n\n\n\n<p>The amounts can vary according to the commune where the guest is staying. Some communes charge a single amount and others do not charge a tourist tax. <\/p>\n\n\n\n<p>In general, there is a capped rate scale \u2013 the higher the <strong><a href=\"https:\/\/www.ovonetwork.com\/blog\/official-classification\/\" target=\"_blank\" rel=\"noreferrer noopener\">official classification<\/a><\/strong> of your property, the higher the tax.
